Crazy-Penny Terms & Conditions
1. General These General Terms and Conditions will apply only to the business conducted between Jomart Group, its online platform www.crazy-penny.com , and its customers. The use of the crazy-penny website constitutes acceptance by the customer of these Terms and Conditions, and acceptance of the methods and procedures outlined on the website www.crazy-penny.com regarding the operation of crazy-penny . These Terms and Conditions may be revised and/or amended from time to time at the sole discretion of Jomart Group. Any reference or suggestion provided by crazy-penny regarding possible strategies for bidding or other use of the website are offered for informational purposes only. Crazy-Penny neither accepts nor incurs any liability or responsibility whatsoever for the actions taken by any customer due to a reliance on any such information.
2. Eligibility to Bid The act of bidding on Crazy-Penny constitutes a declaration by the bidder that they possess legal capacity to enter into a binding contract and that they are 18 years of age or older. No employee or relative of an employee of Jomart Group is permitted to bid in any Crazy-Penny auction. Users may participate in the auctions only if it is legal to do so under the laws that apply in the jurisdiction from which they are connecting. User understands and accepts that CrazyPenny is not able to provide any legal advice or assurances and that it is user's sole responsibility to ensure that at all times they comply with the laws that govern them and that user has complete legal right to bid. Participation in the auctions is void for whomever and/or wherever prohibited by law.
3. Registration Registration is limited to one per user and two per household by postal address only (PO Boxes are not accepted). Users in the same household may not bid on the same auctions. During registration, users must choose a username. Such username can not be deceptive, offensive, or one which infringes upon rights of others. If Crazy-Penny learns of an illegal, deceptive, or offensive username, such username can and will be removed by Crazy-penny with no prior notice. The registered account holder is required to keep private the password that corresponds to the username. Registered accounts cannot be transferred under any circumstances.
4. Disqualification Any abuse of the user account, to the detriment of Crazy-Penny or to third parties, may result in the disqualification of the user along with possible notification to appropriate authorities and/or the pursuit of legal remedies. In general, the user shall be liable for all activities that are undertaken by any person using said user account together with the associated password. Crazy-Penny, in its sole discretion, maintains the right to temporarily or permanently disqualify a registered account holder and close their account should that user violate the terms of this agreement. An account holder's access to the site can be restricted or denied to protect the rights of Crazy-Penny, other users, or third parties. Disqualification can result from activities such as the use of unauthorized bidding software, registration of more than one user account or more than two user accounts in the same household, or any other violation of the terms of this agreement. In the event that these terms are breached, Crazy-Penny maintains the right to cancel deliveries and deny refunds for bids. Crazy-Penny may also restrict the number of auctions a registered account holder may bid in and/or win during any specific period of time.
5. How the Auctions Work / BidJames Each bid on an item will increase the money you could win. The act of bidding constitutes willingness on the part of the user to enter into a binding contract with Crazy-Penny. Every bid resets the countdown timer to a predetermined value. An auction ends when the countdown timer reaches zero. The winner of the auction is the last bidder, as determined by the Crazy-Penny database. Losing bids expire and cannot be refunded. Except in a case of clear error the Crazy-Penny determination as to the winning bid is final. Users can bid online via the appropriate bid buttons, or through a automatic bidder. The automatic bidder enables users to bid even if they are not online or sitting at a computer. Bidding instructions can be specified in advance by the user and the automatic bidder will follow those instructions to place your bids. For more information regarding the operation of the automatic bidder please review the “FAQ" section. No bidding software other than crazy-penny automatic bidder is permitted by Crazy-Penny. The use of any other bidding software can result in immediate and permanent closure of your account.
6. Purchasing Bids Before a user can bid in an auction, he must purchase bids (“bidding rights”), which are available on the website in packages of 10 to 40 bids. Bid packages can be purchased through any of the authorized payment agents identified on the website. Bids used in an auction are deducted from the user’s bid account. There are no refunds issued for any bids, whether used, unused, expired, or free.
7. Purchase Limits Crazy-Penny users are limited to 500 bid purchases via paypal in any 24 hour time period, 1500 bid purchases in any seven (7) day period, and 5000 bid purchases in any 30 day period.
8. Win Limits Crazy-Penny users are limited to two (2) wins per day, based on midnight-to-midnight server time. Additional win limits may be imposed at any time in Crazy-Penny sole discretion. Once a user reaches any such win limit they are restricted from bidding in any further auctions until all such limits’ time restrictions have been satisfied. Any user taking advantage of any flaw in the software to win more than their limit in any respective time period will not be awarded any cash or bids won after such limit has been reached, and there will be no refund of bids placed. It is the user’s responsibility to know when they have reached their limit and to cease bidding in additional auctions. Other users bidding on an auction against a user over their limit are not entitled to any compensation and are encouraged to step down from the auction if they feel uncomfortable bidding against a user over their limit.
9. Cancellations or refunds of deposits Deposits made on Crazy-Penny can not be cancelled or refunded. Confirmed deposits can only be used to purchase bids.
10. Disclaimer of Warranty / Limitation of Liability USER EXPRESSLY AGREES THAT THEIR USE OF THE CRAZY-PENNY WEBSITE IS AT THEIR SOLE RISK. NEITHER CRAZY-PENNY, NOR ITS MANAGEMENT, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS OR THIRD PARTY CONTENT PROVIDERS WARRANT OR GUARANTEE THAT CRAZY-PENNY SERVICES, OPERATIONS, OR CONTENT WILL BE FREE OF INTERRUPTION, MALFUNCTION, OR ERROR. USER ACCEPTS AND ACKNOWLEDGES IN PARTICULAR THAT CRAZY-PENNY BEARS NO LIABILITY FOR OFFENSIVE, UNETHICAL, DEFAMATORY, OR ILLEGAL ACTIONS OF OTHER USERS OR THIRD PARTIES. USER ACCEPTS AND ACKNOWLEDGES THAT THE RISK OF INJURY DUE TO ANY OF THE FOREGOING RESTS EXCLUSIVELY AND ENTIRELY WITH THE USER. IN NO EVENT SHALL CRAZY-PENNY, ITS MANAGEMENT, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS OR THIRD PARTY CONTENT PROVIDERS, NOR ANY INDIVIDUAL OR ENTITY INVOLVED IN ANY WAY IN A CRAZY-PENNY AUCTION, BE LIABLE FOR ANY DAMAGES OF ANY NATURE FOR ANY REASON, ARISING FROM THE USE OF OR INABILITY TO USE CRAZY-PENNY OR ITS CONTENT, REGARDLESS OF THE CAUSE OR DURATION. CRAZY-PENNY SERVICES ARE OFFERED ON AN "AS IS" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CRAZY-PENNY DISCLAIMS ALL REPRESENTATIONS, GUARANTEES, OR WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ANY SERVICES, CONTENT OR MATERIALS, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF FITNESS FOR A SPECIFIC PURPOSE, NON-INFRINGEMENT, NOR FREEDOM FROM COMPUTER MALWARE. CRAZY-PENNY MAKES NO REPRESENTATION REGARDING ANY CONTENT ON THE SITE AS TO ACCURACY, COMPLETENESS OR FREEDOM FROM TYPOGRAPHICAL ERRORS. THIS DISCLAIMER OF LIABILITY SHALL APPLY TO ANY DAMAGES OR INJURY ARISING FROM ANY COMPUTER MALWARE, DEFECT, DELAY, DELETION, ERROR, FAILURE OF PERFORMANCE OR COMMUNICATION, INTERRUPTION, OMISSION, OR FOR ANY THEFT, DESTRUCTION, USE OR MISUSE OF RECORD, FOR ANY CAUSE OR REASON, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, TORTIOUS BEHAVIOR, OR BREACH OF CONTRACT.
11. System Failure / Temporarily Halted Auctions During system failure bids cannot be submitted or accepted, therefore all auctions are temporarily halted until the system is restored. In this situation, the halted auctions' remaining time, current bid, and current high bidder will all be maintained. When the system has been restored, the auctions will resume, generally with an extra period of time added. Temporarily halted auctions will be clearly indicated. Bids placed prior to the temporary halt will not be credited back to the user’s account nor will they be eligible for a refund. There may also be times when it becomes necessary for Crazy-Penny to pause an auction. Should such a situation occur, and Crazy-Penny is able to restart the auction within 30 minutes, 10 minutes will be added to the countdown timer so that all bidders have a chance to follow the bidding action. If Crazy-Penny is unable to restart the paused auction within 30 minutes, the auction will be paused for the day and all involved bidders will be emailed a new start date and time. It is not yet possible to operate or maintain computer programs and systems completely free of errors and malfunctions. The internet is subject to outages and fluctuations from many possible sources and causes. Crazy-Penny therefore cannot provide any guarantee of uninterrupted availability of its website and technical systems. Crazy-Penny disclaims all liability for damage incurred as a result of any technical faults or failures while using the Crazy-Penny website or services. Specifically, Crazy-Penny disclaims liability for damage occuring due to bids apparently submitted that are not registered by Crazy-Penny, or not received timely, as a result of such technical faults.
12. External Links The Crazy-Penny website may provide links to other websites owned by third parties. These sites may also provide links to other websites. Despite our efforts to verify such links and sites, we disclaim any liability for the content of those sites. The owners of those sites are solely and completely responsible for the content of their sites.
13. Trademarks All Crazy-Penny logos are trademarks of Jomart Group and its subsidiaries. All rights reserved. All other trademarks appearing on Crazy-Penny are the property of their respective owners.
14. Applicable Law / Severability Clause The Terms and Conditions set forth in this Agreement shall be governed by the laws of the Republic of Cyprus. Any legal action or proceeding related to this website shall be brought exclusively in a federal or state court of competent jurisdiction in the Republic of Cyprus.
15. Protection of Collected Data Please refer to our Privacy Policy for information on the collection and use of your personal data.
16. Collusion / Team Play Any form of collusion or team play on Crazy-Penny is strictly forbidden. Collusion includes, but is not limited to, two or more members working together as a team to the detriment of other bidders. Crazy-Penny reserves the right, in its sole discretion, to disqualify any user they suspect to be working in a team. A user disqualified for collusion will have all their wins voided and their accounts frozen. No frozen funds or bids will be returned or transferred into other accounts.
17. General The contract between Crazy-Penny and its customers is binding on the parties and on their respective successors and assigns. The customer may not transfer, assign, charge or otherwise dispose of any contract formed under these General Terms and Conditions or any rights or obligations under these Terms without the prior written consent of Crazy-Penny. Crazy-Penny reserves the right to revise and/or amend these General Terms and Conditions as appropriate in its absolute discretion. All users will be subject to the policies and terms and conditions that are in effect at the time that they bid in auctions on the Crazy-Penny website. All intellectual property rights and content published on the Crazy-Penny website are owned or licensed by Crazy-Penny. All content on the Crazy-Penny website is protected by worldwide copyright laws and treaties and all rights relating to this content are reserved. These Terms and Conditions and any other rules pertaining to and produced by Crazy-Penny constitute the entire agreement of the parties with respect to the operation and use of the Crazy-Penny website. This Agreement shall be construed in accordance with the laws of the Republic of Cyprus. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
